Terms of Service

These Terms of Service ("Terms") govern your use of the MyHeroMed platform, website, and related services (collectively, the "Platform") operated by MyHeroMed, Inc. ("MyHeroMed," "we," "our," or "us"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Eligibility

You must be at least 18 years of age, located in the United States, and legally capable of entering into a binding agreement to use the Platform. By creating an account, you represent that you meet these requirements and that all information you provide is accurate, current, and complete. You agree to update your information promptly if it changes.

Description of Services

MyHeroMed is a telehealth platform that connects patients with licensed, board-certified healthcare specialists for remote consultations via secure messaging and live video. We facilitate the connection between patients and independent healthcare providers. MyHeroMed does not itself provide medical services — all clinical care, diagnoses, treatment plans, and prescriptions are delivered by independent, licensed healthcare professionals who use our Platform.

Informed Consent for Telehealth

By using the Platform for a consultation, you acknowledge and consent to the following:

  • Your consultation will be conducted remotely using electronic communications, including secure messaging and/or live video.
  • Telehealth has limitations. Your specialist cannot perform a physical examination, and some conditions may require an in-person visit for proper evaluation.
  • As with any medical consultation, there are potential risks, including the possibility of misdiagnosis or incomplete diagnosis due to the remote nature of the encounter.
  • You have the right to withdraw your consent and discontinue a telehealth consultation at any time.
  • Your specialist will inform you if your condition requires in-person care and will recommend appropriate next steps.
  • Technical disruptions may occur during video consultations. If a session is significantly interrupted, your specialist will work with you to complete the consultation or reschedule.
  • You consent to the creation, storage, and transmission of electronic health records related to your consultation, as described in our Privacy Policy.

Scope of Practice and Limitations

  • State licensing: Healthcare providers on MyHeroMed are licensed in the state(s) where they practice. You may only receive care from a provider who is licensed in the state where you are physically located at the time of the consultation. It is your responsibility to accurately report your location.
  • Scope of services: MyHeroMed consultations are appropriate for non-emergency specialist evaluations, second opinions, follow-up consultations, treatment guidance, and prescription management. They are not a substitute for in-person care when hands-on examination or procedures are medically necessary.
  • Prescriptions: Specialists may prescribe medications when clinically appropriate, in accordance with applicable state and federal regulations. Certain controlled substances may not be prescribed via telehealth depending on state law and clinical judgment. Prescriptions are sent electronically to your preferred pharmacy.
  • No ongoing physician-patient relationship: Unless otherwise agreed upon by you and your specialist, a single consultation does not establish an ongoing physician-patient relationship beyond the scope of that consultation.

Emergency Situations

MyHeroMed is not designed for medical emergencies. If you are experiencing a medical emergency — including but not limited to chest pain, difficulty breathing, severe bleeding, loss of consciousness, or signs of stroke — call 911 or go to your nearest emergency room immediately. If you are experiencing suicidal thoughts or a mental health crisis, call or text 988 (Suicide & Crisis Lifeline). Do not use this Platform to seek emergency care.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Each person may maintain only one account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account. You may not share your account or allow others to use your account to receive medical consultations on their behalf. See "Termination" below for information on closing your account.

Payments, Pricing, and Refunds

  • All consultation prices are displayed clearly before you book. There are no hidden fees.
  • When you book a consultation, your payment method is authorized (not charged) for the consultation fee.
  • Your card is only charged when a specialist accepts your case and begins the consultation.
  • If no specialist accepts your case, or if you cancel before a specialist accepts, the authorization is released and you are not charged.
  • Payments are processed securely by Stripe, a PCI DSS Level 1 certified payment processor. MyHeroMed never stores your full card number.
  • MyHeroMed is not an insurance product. Services are provided on a direct-pay basis and are not billed to insurance.
  • HSA and FSA funds may be used to pay for consultations, as they are qualified medical expenses.
  • If you believe you were charged in error, contact [email protected] and we will investigate promptly.
  • Refund policy: If a specialist is unable to provide a meaningful consultation (for example, due to a sustained technical failure or a mismatch in specialty), you may request a full refund. Refund requests must be submitted within 7 days of the consultation by contacting [email protected]. Refunds are processed to your original payment method within 5–10 business days. We do not offer refunds for completed consultations where clinical care was delivered as described, as clinical outcomes are not guaranteed.

Acceptable Use

You agree not to:

  • Provide false identity information or impersonate another person.
  • Use the Platform for any unlawful purpose or to solicit illegal activity.
  • Interfere with or disrupt the Platform's infrastructure or security.
  • Attempt to access another user's account or data.
  • Use the Platform to seek medications for non-medical purposes.
  • Upload malicious files, viruses, or other harmful content.
  • Harass, abuse, or threaten any specialist or other user.
  • Scrape, crawl, or use automated means to access the Platform or extract data.
  • Reverse-engineer, decompile, or disassemble any part of the Platform's software.

We reserve the right to suspend or terminate your account for violation of these Terms, with or without notice.

Termination

You may close your account at any time by contacting us at [email protected]. Upon closure, we will deactivate your account and delete your personal data in accordance with our Privacy Policy, subject to any legal retention requirements for medical records.

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required by law. If we terminate your account, any outstanding consultation fees owed to you or by you will be settled according to the circumstances of the termination.

Intellectual Property

All content, branding, software, and design elements of the Platform are owned by MyHeroMed or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent. Health information and content shared during your consultations remain your property.

Independent Healthcare Providers

Healthcare specialists on the Platform are independent contractors, not employees or agents of MyHeroMed. MyHeroMed is not responsible for any specialist's clinical decisions, diagnoses, treatment recommendations, or prescriptions. Each specialist is independently licensed and responsible for their own clinical practice. MyHeroMed takes reasonable steps to verify provider credentials and licensing status but does not direct, control, or supervise clinical care.

Limitation of Liability

To the fullest extent permitted by applicable law, MyHeroMed shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of data, loss of revenue, or personal injury arising from clinical decisions made by independent healthcare providers. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to MyHeroMed for the specific consultation giving rise to the claim.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded by law.

Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Indemnification

You agree to indemnify and hold harmless MyHeroMed, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

Dispute Resolution

Informal Resolution First

Before filing a formal dispute, you agree to contact us at [email protected] and allow 30 days to attempt to resolve the matter informally.

Binding Arbitration

If informal resolution is unsuccessful, any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You agree to resolve disputes on an individual basis and waive the right to participate in a class action or class-wide arbitration.

Small Claims Exception

Either party may bring an individual action in small claims court instead of arbitration, provided the claim falls within that court's jurisdictional limits.

Arbitration Opt-Out

You may opt out of the arbitration and class-action waiver provisions by sending written notice to [email protected] within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in Delaware.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

Electronic Communications

By using the Platform, you consent to receive communications from us electronically, including emails, push notifications, and messages within the Platform. You agree that all notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on our Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

General Provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyHeroMed regarding the Platform and supersede all prior agreements and understandings.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
  • Force majeure: MyHeroMed is not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, pandemics, internet outages, government actions, or third-party service disruptions.
